Bill provides for the installation of duty-free stores in Foz do Iguaçu


The Legal Department of the Legislative Branch is analyzing Bill 82/2015, which “provides for the installation of duty-free stores in the Municipality of Foz do Iguaçu”, also known as duty-free shops. 

Authored by the Councilor and President of the Chamber, Fernando Duso (PT), the project may receive constitutional support, as it provides that products to be sold in duty-free stores will comply with the special customs regime for duty-free stores, as provided for in the Federal Law 12.723/2012 and in the regulation issued by the Brazilian Federal Revenue Secretariat. “What we are seeking to do with this Bill is to regulate an ordinance already issued by the Federal Revenue in July this year, which regulated the general provisions on the installation of duty-free stores, also providing for a special customs regime in foreign cities in border line of Brazil, which includes Foz do Iguaçu”, highlighted Duso when defending the PL he authored.

The project, which will still be processed by the Permanent Committees of the House of Law, and which could enter the voting agenda in October, highlights that it will be up to the Municipal Executive Branch, based on the rules and guidelines provided for in the Organic Law of the Municipality and the Master Plan, stipulate the criteria for issuing operating licenses to the aforementioned commercial establishments, as well as providing locations for their installation.   

“The Federal Revenue ordinance provides specific requirements for the granting of this special customs regime, with several conditions to be met, including the existence of a municipal law that generally authorizes the installation of duty-free stores in its territory. And this is what we are doing”, highlighted the Councilor.    

Duso argues that the first step to be taken is the approval of the Bill and, subsequently, specifications in the Municipal Law that meet the determinations of Federal Law 12.723/12. “In order to meet the requirements of the Ministry of Finance and considering that the sale of tax-free products aims to attract tourists who are in transit through the Municipality, I guarantee that we will be promoting economic development, and contributing to the generation of employment and consolidating local tourism even more”, concluded Fernando Duso.    

As soon as the Legislative Legal Department issues its opinion on the Bill, the document will be analyzed by the Legislation, Justice and Writing Committee, chaired by Councilor Luiz Queiroga (DEM) and will also be analyzed by the Economy, Finance and Budget Committee, presided over by Councilor Edílio Dall' Agnol.
